Welcome to SimpleSafeCloud. By using our website and services (the "Service"), you agree to these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account or using SimpleSafeCloud, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service. You must be at least 18 years old to use the Service.

2. Description of Service

SimpleSafeCloud provides zero-knowledge encrypted cloud storage. Your files are encrypted on your device before being uploaded to our servers. We do not have access to your encryption keys or the contents of your files.

3. Account Responsibilities

Your Account

  • You are responsible for maintaining the security of your account credentials (email, password)
  • You must provide accurate and complete information when creating your account
  • You are responsible for all activity that occurs under your account
  • You must notify us immediately if you suspect unauthorized access to your account

Your Password and Encryption

Important: You Are Responsible for Your Password and Recovery Key

Because SimpleSafeCloud uses zero-knowledge encryption, we cannot recover your files if you lose both your password and your Recovery Key. Your encryption key is derived from your password, and we never have access to it. Please store your Recovery Key in a safe place.

  • Your files are encrypted using a key derived from your password
  • We do not store your password or encryption key on our servers
  • When you create your account, you will receive a Recovery Key
  • You are solely responsible for keeping your Recovery Key safe
  • If you lose both your password and Recovery Key, your encrypted data cannot be recovered by anyone, including us

4. Acceptable Use

You agree not to use the Service to:

  • Store or distribute content that is illegal under U.S. federal or state law
  • Store or distribute child sexual abuse material (CSAM) or any content exploiting minors
  • Distribute malware, viruses, or other harmful software
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to other users' accounts or data
  • Use the Service for any purpose that violates applicable laws or regulations
  • Resell, redistribute, or sublicense the Service without our written permission

While we cannot view the contents of your encrypted files, we reserve the right to terminate accounts that we reasonably believe are being used in violation of these Terms.

5. Payment Terms

Free Plan

The Free plan provides 2 GB of encrypted storage at no charge. We reserve the right to modify Free plan features or storage limits with 30 days' notice.

Billing Terms and Definitions

  • A "term" refers to a billing period of 30 days from the date of purchase or renewal
  • "First term" refers to the initial 30-day billing period that begins on the date of your first payment
  • After the first term, your subscription will automatically renew at the standard annual rate unless cancelled

Premium Plan

  • The Premium plan is billed at $99/year (annual) or $14.99/month (monthly)
  • Introductory pricing may be offered for the first term; the introductory rate applies to the initial 30-day term only
  • After the first term, the subscription will automatically renew annually at $99/year unless cancelled through your online portal
  • Subscriptions automatically renew at the end of each billing period
  • You may cancel auto-renewal at any time from your account settings
  • Prices may change with 30 days' advance notice; existing subscriptions will honor the original price until renewal

Lifetime Plan

  • The Lifetime plan is a one-time payment of $249 for 500 GB of encrypted storage
  • "Lifetime" means the lifetime of the Service, not the lifetime of the user
  • If SimpleSafeCloud ceases operations, we will provide at least 12 months' notice and assist with data migration

Payment Processing

All payments are processed securely through Stripe. By making a purchase, you also agree to Stripe's Terms of Service.

6. Refund Policy

30-Day Money-Back Guarantee

If you are not satisfied with your purchase, you can request a full refund within 30 days of your initial payment, no questions asked. This applies to both Premium and Lifetime plans.

  • Refund requests must be made within 30 days of the initial purchase date
  • For annual/monthly renewals after the first 30 days, refunds are not available, but you may cancel to prevent future charges
  • Refunds are processed to the original payment method within 5-10 business days

7. Service Availability

  • We strive for 99.9% uptime but do not guarantee uninterrupted service
  • We may perform scheduled maintenance with advance notice when possible
  • We are not liable for any data loss due to circumstances beyond our reasonable control

8. Intellectual Property

  • You retain full ownership of all files and content you upload to the Service
  • Because your files are encrypted with zero-knowledge encryption, we have no ability to access, use, or claim any rights over your content
  • The SimpleSafeCloud name, logo, website design, and software are our intellectual property and may not be copied or used without permission

9. Termination

By You

  • You may cancel your subscription at any time from your account settings
  • You may delete your account at any time, which will permanently remove all your data

By Us

  • We may suspend or terminate your account if you violate these Terms
  • We will provide reasonable notice before termination when possible
  • In cases of severe violations (illegal use, abuse), we may terminate immediately
  • Upon termination, you will have 30 days to download your files (unless terminated for illegal activity)

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • SimpleSafeCloud is provided "as is" and "as available" without warranties of any kind, express or implied
  • We do not warrant that the Service will be error-free, uninterrupted, or completely secure
  • Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • We are not liable for data loss resulting from you losing your password and Recovery Key

11. Indemnification

You agree to indemnify and hold SimpleSafeCloud harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of the State of Delaware.

13. Changes to These Terms

We may update these Terms from time to time. When we make significant changes, we will notify you by email and update the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
