DMCA Policy

Overview

SimpleSafeCloud respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond to valid notices of alleged copyright infringement.

Zero-Knowledge Encryption: SimpleSafeCloud uses end-to-end encryption. We cannot view the contents of files stored on our platform. However, when we receive a valid DMCA notice referencing a share link, we can disable that share link and take action against the account holder, including suspension or termination for repeat infringers.

Filing a DMCA Takedown Notice

If you believe that content shared through SimpleSafeCloud infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the material claimed to be infringing, including the share link URL (e.g., simplesafecloud.com/s/...)
  4. Your contact information, including name, address, telephone number, and email address
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf

What Happens After We Receive a Notice

  • We will review your notice for completeness and validity
  • If the notice is valid and references a share link, we will promptly disable the share link
  • We will notify the account holder that their content has been the subject of a DMCA notice
  • The account holder may submit a counter-notification (see below)

Counter-Notification

If you believe your content was removed or disabled in error, you may submit a counter-notification to our designated agent including:

  1. Your physical or electronic signature
  2. Identification of the material that was removed or disabled and the location at which it appeared before removal
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district and will accept service of process from the person who filed the original notice

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the disabled content.

Repeat Infringer Policy

SimpleSafeCloud maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. If a user's account is the subject of multiple valid DMCA notices, we may suspend or permanently terminate their account.
